1. How To Enter: To enter the AT&T Game Developer Contest ("Contest"),
you need to create an original game application to run on the Windows Mobile
platform. Between 12:01 a.m. U.S. Eastern Time (ET) on April 28, 2008 and 11:59:59
p.m. ET on July 31, 2008, go to the Contest website www.tcspromo.com/devcontest/index.cfm
("Website") to register and submit the following entry materials (your
"Submission"):
a. a properly completed official entry form (available on the
website);
b. a digital copy (CAB file) of your Windows-based gaming application
in usable form. Your gaming application must be intended for and function on
at least one (1) the following type(s) of handsets: AT&T Tilt, Samsung Blackjack
II, AT&T 8525. Any additional files required for installation or use should
also be included. You are strongly encouraged to read and follow the
game design guidelines available http://developer.att.com/developer/.
c. a jpg screenshot that best depicts your application.
d. a description of the game in 100 words or fewer.
e. instructions on how to play the game in 100 words or fewer.
f. a technical explanation of how the game was designed in
100 words or fewer.
g. a description of yourself in 100 words or fewer.
"Entry" means all of the entry information plus the Submission you submit at the Website. All Entries must be in English. Entries must be received by 11:59:59 p.m. ET, July 31, 2008, when the Contest ends. Sponsor's computer is the official clock for purposes of Contest entry. Proof of delivery or receipt of Entry will not be deemed by Sponsor as proof of entry into this Contest. Limit one Entry per person. If an entrant submits more than one (1) Entry to this Contest, only his/her first Submission will be entered and any additional Entries shall be void. Any attempted form of entry into this Contest other than as described herein is void and ineligible for the Contest. Submissions must not contain offensive or lewd content. As determined by Sponsor, in its sole discretion, any Submission which includes material unfit for publication, objectionable material, material that defames or invades (or may defame or may invade) the publicity or privacy rights of any person, living or deceased, or otherwise infringes (or may infringe) upon any person's or entity's personal or proprietary rights will be disqualified. Any Submission which is not reasonably pertinent to the judging criteria described below or otherwise appropriate as determined by Sponsor, in its sole discretion, or is otherwise in violation of these Official Rules, will be disqualified and ineligible for the Contest.
2. Eligibility: Contest is open to persons 18 or older as of May 1, 2008. Employees, officers, directors, agents and representatives and their immediate families (parent, child, spouse, sibling) and household members of the foregoing (whether related or not) of AT&T Mobility, LLC, Microsoft, I-play, Inc., HTC Corporation and their respective affiliated, parent and subsidiary companies, advertising and promotion agencies and anyone involved in this Contest's production, development or handling (collectively, along with Sponsor, "Contest Entities") are not eligible. This Contest is subject to all federal, state and local laws and regulations. Void in Norway, Spain and where restricted or prohibited by law.
3. Judging/Notification/Verification of Winners: All Submissions
from eligible Entries will be judged by a judging panel, whose decisions are
final on all aspects of the Contest, on the following criteria: game play value
and quality (50%); game uniqueness and creativity (25%); and public appeal/marketplace
potential (25%). All Submissions are subject to validation by the judges and/or
contest administrator. Based on the above judging criteria, the judges will
first select ten (10) semi-finalists on or about August 15, 2008; from these
semi-finalists the judges will select three (3) finalists on or about August
20, 2008; and from these finalists the judges will select one (1) Grand Prize
Winner who will be announced on or about September 10, 2008 at the CTIA conference
in San Francisco. Semifinalists and Finalists will be notified by phone, email
and/or postal mail within approximately 2 days after selection. If any potential
winner cannot be reached after a reasonable effort has been exerted, if he/she
is found to be ineligible, if he/she cannot or does not comply with these Official
Rules, or if his/her prize or prize notification is returned as undeliverable,
potential winner will be disqualified and an alternate potential winner may
be selected at Sponsor's sole discretion. By entering, you agree to be bound
by these Official Rules and all decisions of the judges. Each potential prize
winner (or his/her parent/legal guardian if a resident of a jurisdiction that
deems him/her to be a minor) must sign and return, within 7 business days after
delivery to his/her address, an Affidavit of Compliance with these Official
Rules, a Prize Release and a Publicity Release (where legal) for use of his/her
name, likeness, and biographical information without further notice or compensation
unless prohibited by law. Grand and Runner-Up Prize Winners and guests will
also be required to sign and return a travel release. Failure to
sign and return these forms within 7 business days after original delivery to
winner may, at the sole discretion of Sponsor, result in forfeiture of prize
and selection of an alternate potential winner. Entry materials
void if incomplete or if they contain errors. All Entries become property of
Sponsor and will not be returned.
4. OWNERSHIP/USE OF SUBMISSION: Your Submission must be unpublished
prior to being submitted (other than self-publication by you). Any gaming application
that has been published at any time by any generally recognized application
publisher or by any company other than yourself is not eligible. You must hold
all necessary rights in all aspects of your Submission for publication, including
but not limited to images, music, likenesses, game concepts, characters, third-party
game engines, middleware, and any other components. By entering, you (a) grant
permission to Sponsor and its agents and agencies the perpetual and irrevocable
right to copy, distribute, publish, use, adapt, edit and/or modify your Submission
in any way, in any and all media worldwide, without limitation; (b) irrevocably
assign and transfer to Sponsor all right, title and interest in the Submission,
including without limitation, all copyrights, without further consideration;
(c) represent and warrant your Submission is your own original work and that
you are the owner or have obtained and currently hold valid and sufficient worldwide
rights in third-party material incorporated into your Submission to grant the
Sponsor all rights necessary under these Official Rules; (d) agree that Sponsors
may publish your name and entry on the Contest Website or Sponsor's website
or in such other media or formats as Sponsor may elect without further compensation;
and (e) agree to execute and deliver to Sponsor such assignments or other instruments
as Sponsor may deem reasonably necessary to establish, protect, enforce and/or
defend any or all of Sponsor's rights in the Submission and/or under these Official
Rules. If you fail to so execute and deliver any such instrument after reasonable
notice, Sponsor shall have the right to do so in your name, place and stead,
and Sponsor is hereby irrevocably appointed as your attorney-in-fact for such
purposes, which power is coupled with an interest. Sponsor reserves the right
to require written proof of all rights. You are solely responsible if you submit
any material in which you don't hold such rights and you agree to indemnify
and hold Sponsor harmless from any claims by third parties that you lacked any
such rights.
By entering this Contest, you agree that Sponsor has the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of your Submission however it sees fit and for any purpose without any notice or compensation to you or any third parties, and that Sponsor has the right to use your Submission for advertising/publicity purposes worldwide and in all forms of media in perpetuity, without further notice to or compensation in connection with this Contest. You agree that your Submission as advertised/promoted may differ from the Submission originally submitted due to technical errors, compatibility problems or other issues, and Sponsor shall have no liability related thereto. You agree that Sponsor has no obligation to advertise/publicize your Submission. Sponsor reserves the right to disqualify entrants whose Submissions have already been published. By entering this Contest, you agree that your name and Submission may be posted on the Contest website in connection with the Contest.
5. PRIZES:
ONE (1) GRAND PRIZE: The Grand Prize Winner will receive:
a. the opportunity for a mobile game distribution contract
with I-play on I-play's standard terms (subject to the game meeting I-play's
quality assurance requirements; any distribution is subject to the conclusion
of a standard publishing and distribution agreement between I-play and grand
prize winner);
b. the opportunity for placement (as determined by Sponsor)
of game on the games portal on AT&T Media Mall, subject to Sponsor's determination
of appropriateness in its discretion;
c. $25,000 (US);
d. a trip for winner and guest to the CTIA conference in San
Francisco (September 10-12, 2008);
e. the announcement and recognition of Grand Prize Winner at
the CTIA conference;
f. passes for winner and guest to PDC;
g. security and certification signing waivers;
h. an HTC Mobile Phone
The total approximate retail value ("ARV") of Grand Prize is $30,000, depending on location of winner's residence, departure times and any airfare fluctuations.
TWO (2) FINALIST PRIZES: The remaining two (2) finalists will
each receive:
a. $5,000 (US);
b. a trip for runner-up and guest to the CTIA in San Francisco
(September 10-12, 2008);
c. passes for runner-up and guest to PDC;
d. security and certification signing waivers;
e. an HTC Mobile Phone
The ARV of each Finalist Prize is $10,000, depending on location of winner's
residence, departure times and any airfare fluctuations.
Trip for Grand Prize Winner and each Finalist Prize consists of: round-trip,
economy-class air transportation for two (2) between the major airport with
regularly scheduled flights closest to the winner's permanent residence (as
determined by Sponsor in its sole discretion) and San Francisco, CA; (b) two
(2) nights standard hotel accommodations (one double occupancy room and room
tax only) in San Francisco area; (c) ground transportation to/from hotel and
airport. Ground transportation may be provided in lieu of air travel if winner
resides within 100 miles of San Francisco, CA. If winner is a resident of a
jurisdiction that deems him/her to be a minor, parent/legal guardian must travel
as the allotted guest. If guest is a resident of a jurisdiction that deems him/her
to be a minor, he/she must be accompanied by his/her parent/legal guardian,
and such person must pay his/her own expenses unless he or she is the winner.
Winner and guest must travel on same itinerary on dates to be designated by
Sponsor. All incidental expenses and taxes not specified herein will be the
sole responsibility of the winner and his/her travel companion, including without
limitation other ground transportation, food, and beverages. Winner and guest
will be responsible for all applicable travel and other insurance, all applicable
airport charges including without limitation, any excess baggage charges, airport
taxes, and tickets are not transferable, refundable or redeemable. Sponsor will
not replace any lost or stolen tickets, travel vouchers or certificates. Once
booked, no change, extension, or substitution of trip dates is permitted, except
by Sponsor at its sole discretion. If the CTIA conference is postponed or cancelled,
remainder of prize will be awarded as total prize.
Ten (10) SEMI-FINALIST PRIZES:
a. Entry into Microsoft WM Beta Developer Program;
b. WM Certification Waivers
The ARV of each Semi-Finalist Prize is $500.
Winners are responsible for any and all federal, state and/or local taxes resulting
from acceptance of the prize, and cannot assign or transfer the prize to another
person. No cash or prize substitution is allowed except at the discretion of
Sponsor. If the prize or a prize component cannot be awarded due to circumstances
beyond the control of Sponsor, a substitute prize or prize component of equal
or greater retail value will be awarded. In the event that a publishing contract
cannot be agreed to between Grand Prize Winner and I-play, then remaining elements
of prize shall constitute full satisfaction of Sponsor's prize obligation to
Grand Prize Winner and no additional compensation will be awarded.
6. General Conditions: Contest is subject to these Official
Rules and all federal, state and local laws (collectively, "Rules and Laws").
By entering, you agree to be bound by the Rules and Laws and to release, discharge
and hold harmless Contest Entities from all claims or damages arising out of
your participation in this Contest and/or acceptance, ownership or use of the
prize or prize related activity. Contest Entities do not provide any implied
or express warranty, guarantee or representation, in law or equity, pertaining
to any third party product or service supplied in whole or in part as a prize
for this Contest. If for any reason any electronic portion of the Contest is
not capable of running as planned, including infection by computer virus, bugs,
tampering, unauthorized intervention, fraud, technical failures, or other causes
which corrupt or affect the administration, security, fairness, integrity or
proper conduct of the Contest, Sponsor reserves the right, at its sole discretion,
to cancel, terminate, modify or suspend the Contest, to disqualify any individual
who tampers with any entry process, and to award the prize among eligible entries
not affected by the problem or in a manner that is fair and equitable. Any person
attempting to defraud or tamper with this Contest will be prosecuted and is
not eligible for a prize. No responsibility or liability is assumed by Contest
Entities (including, but not limited to, liability for any property loss, damage,
personal injury or death) in connection with participation in this Contest,
for any human error, for acceptance/possession, use/misuse of the prize awarded,
for any error, omission, interruption, deletion, defect, delay in operation
or transmission, busy signals, communication network failure, theft or destruction
or unauthorized access to, or alteration of entries; or any problems or technical
malfunctions of any wireless or wired telephone network, computer online systems,
servers, or providers, computer equipment, software; or failure of any entry
to be received on account of technical problems or traffic congestion on any
telephone or internet connection, or any combination thereof, including any
injury or damage to your or any other person's computer related to or resulting
from participation in or uploading any materials for this Contest, even if caused
by the negligence of one of the Contest Entities. No responsibility is assumed
by Contest Entities for, Entries that are entered by other than human means
(such as by an automated computer program or any non-human mechanism, entity,
or device), or for Entries or materials that are illegible, late, mutilated,
tampered with, forged, incomplete, misdirected, lost, misplaced, stolen, destroyed,
postage-due or otherwise not in compliance with these Official Rules and such
Entries will be disqualified.
